GENERAL WAIVER AND RELEASE OF LIABILITY

In consideration of the potential risks of injury while participating in any & all activities, classes or events , as consideration for the right to participate in all The Light Body Lifestyle activities, classes or events, I hereby, for myself, my heirs, executors, or personal representatives KNOWINGLY AND VOLUNTARILY enter in to this waiver and release of liability any any and all rights, claims or causes of action of any kind whatsoever arising out of my participation in the activity, class or event and do hereby release and forever discharge all facilitators, staff, their affiliates, agents, attorneys, heirs, representatives, predecessors, successor and assigns for any physical or psychological injury, including but not limited to illness, paralysis, death, damages, economical or emotional loss, that I may suffer as a direct result of my participation in the aforementioned activity, classes or event, including any traveling to and from this event, activity or class.

 

I am voluntarily participating in the aforementioned activity, class or event and I am participating in the activity, class or event at my own risk. I have considered and am aware of the risks associated with traveling to and from as well as participating in the activity, class or event. I understand possible injuries or undesired outcomes may arise during my participation from my own or others negligence, conditions related to travel, or conditions of the activity location(s). Nonetheless, I assume all related risks, both known or unknown to me, of my participation of the activity, class or event, including travel to and from this activity, class or event.

I agree to indemnify and hold harmless all The Light Body Lifestyle facilitators, staff, their affiliates, agents, attorneys, heirs, representatives, successors and assigns  against any and all claims, suits, or action of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney's  fees and any related costs if litigation arises pursuant to any claims made by me or by anyone acting on my behalf, If The Light Body Lifestyle facilitators, staff, representatives,  predecessors, successors or assigns incurs any of these types of expenses, I agree to reimburse them directly within 90 days. I acknowledge that all facilitators of The Light Body Lifestyle are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific activity, class or event on behalf of The Light Body Lifestyle.

I ACKNOWLEDGE THAT THIS ACTIVITY, CLASS OR EVENT MAY INVOLVE A CHALLENGE OR TEST OF A PERSON'S PHYSICAL, MENTAL AND EMOTIONAL  LIMITS AND MAY CARRY WITH IT THE POTENTIAL FOR SERIOUS INJURY, PROPERTY LOSS OR DEATH.  These risks include but are not limited to those caused by terrain, facilities, temperature, weather, lack of hydration, condition of participants, equipment, vehicular traffic, and actions of others, including but not limited to any and all participants.

I AFFIRM THAT I AM IN GOOD GENERAL HEALTH. I DO NOT HAVE ANY PHYSICAL OR MENTAL HEALTH CONDITIONS THAT ARE INCOMPATIBLE WITH PARTICIPATING IN THIS ACTIVITY, CLASS OR EVENT. Female participants only: I AM NOT PREGNANT. 

 

I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS "WAIVER AND RELEASE" AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I expressly agree to release and discharge The Light Body Lifestyle facilitators and all affiliates, staff, representatives, agents, heirs, successors, and assigns from any and all claims or causes of action and i agree to voluntarily give up or waive any right that I otherwise have to bring legal action against The Light Body Lifestyle facilitators and all affiliates, staff, representatives, agents, heirs, successors, and assigns for any and all personal injury or property damage.  To the extent that statute or case law not prohibit release for negligence, this release is also for negligence on the part of The Light Body Lifestyle facilitators and all affiliates, staff, representatives, agents, heirs, successors, and assigns.

 

In the event that I should require medical treatment, I agree to be financially responsible for any and all costs incurred as result of such treatment.

In the event that any provision contained within this release of liability shall be deemed to be severable or invalid, or if any term, condition, phrase or portion of this agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect, so long as the clause severed does not affect the intent of the parties. If a court should find that any provisions of this agreement to be invalid or unenforceable, then said provisions shall be deemed to be written, construed and enforced as so limited.

I, the undersigned participant affirm that I am of the age of 18 years or older, and that I am freely signing this agreement. I certify that I have read this agreement, that I fully understand its content and that this release cannot be modified orally.

Any and all under 18 yrs of age must have consent & signature from their actual parent or legal guardian. Parent or legal guardian please sign above. By adding a youths name below, you are stating that you are in fact the parent, legal guardian or legal representative for the named youth(s) and are accepting full and complete responsibility for the individuals added below. You have read and understand this Waiver and Release form in its entirety and are giving full permission for those you are signing for below to participate in this The Light Body Lifestyle activity, class or event.
